JURISPRUDENŢA CURŢII CONSTITUŢIONALE A ROMÂNIEI

Abstract

In this case law section we have selected a number of cases in which the Constitutional Court of Romania (hereinafter CCR) has ruled with reference to the legal institution of possession, revealing its importance, the legal means of protection, both through civil law and criminal law, the limitations and effects of possession.

The examination of case law reveals not only the richness and diversity of the legal issues of a constitutional nature in this matter, but also an interesting historical development of the institution under analysis, both in terms of regulation and approach by the constitutional judge. Moreover, such summaries, which highlight the landmarks of the CCR's case law over more than three decades, are in themselves a way of illustrating the evolution of constitutional justice and constitutionality review in Romania.
