Abstract

The de facto occupation of privately owned land by the state authority through the de facto extension of works for the realisation of public interest objectives, carried out on expropriated land neighbouring the land actually occupied, has the consequence that this land is assimilated to the land expropriated for public utility, and the owners must be compensated according to the procedures regulated by the laws governing formal expropriation.
