Recalculation of the military pension in virtue of Law no. 223/2015. Choice of the period of 6 consecutive months with a view to determine the calculation base

Abstract

The legislator opted for the “month” time unit, the purpose of the regulation consisting in facilitating the correct collection and determination of the revenues which are the calculation base (pays/salaries related to the position or similar salary elements realized in those 6 consecutive months), as well as to make a correct discount thereof, in compliance with the complex procedure governed by art. 12 of the Order for approval of the recalculation procedures and discount of the State military pensions. If the legislator’s intent had been different, the “days” time unit would have been used, which would had allowed the beneficiaries of the recalculation of the pension entitlements to choose a period different from the whole calendar months.
