Abstract
The court finds that the treatment applied to the claimant, for a long period, for the purpose of withdrawing the job duties, combined with the issue of letters to the respondent’s clients, being of denigrating nature against the claimant, shall represent actions materializing the psychological harassment of the latter, for the purpose of determining the employee to terminate the employment relationships with the respondent.
It follows from the examination of evidence produced in the case that there was a repetitive behaviour of the employer, which determined the deliberate deterioration of the working conditions of the appellant, his isolation, by disregard actions before the employer’s clients to which the claimant traveled for business purposes and by actions of professional discredit of the claimant, as well as by non-assignment of the old job duties, withdrawal of the means needed for the performance of the old job duties and the assignment of certain duties below the professional training of the employee, for the purpose of determining him to terminate the employment relationships by resignation.
Thus, the employer’s acts were likely to prejudice the dignity in work of the claimant appellant, by imprinting the feeling of usefulness.
