Abstract

It is illegal to deny the right to practice law on the territory of the Romanian State, under the title obtained in another EU member state, including in Romanian law, related to the provisions of Article 98 of Law no. 51/1995 and Article 5 paragraph 1 of the Directive 98/5/EC of the European Parliament and Council, of 16 February 1998. The condition laid down in Article 13 of Law no. 51/1995, for passing an exam to verify the knowledge of Romanian law and language, is applicable only to foreign lawyers from other states than those members of the European Union.
