Abstract

For the purposes of applying the threshold provided for in Article 11 para. (4) of Law no. 153/2017 on the salaries of staff paid from public funds, the salary income of the civil servant must also be compared with the increase provided for in Art. 16 para. (1) of the included law, and the salary income thus calculated must be capped at the level of the monthly allowance of the office of deputy mayor excluding the increases provided for in Art. 16 para. (2).

The local public authority unlawfully considered that the threshold relates to salary income which does not include the increase provided for in Article 11(4) of Law no. 153/2017 on the salaries of staff paid from public funds.
