JURISPRUDENŢA CURŢII CONSTITUŢIONALE A ROMÂNIEI

Abstract

The study examines the procedure for the resolution of pleas of unconstitutionality at the constitutional dispute stage, before the Constitutional Court, revealing some aspects related to the legal regime of procedural incidents in the resolution of these pleas. The purpose of the analysis is to highlight applicable rules, regulatory problems existing over time, solutions identified by the Constitutional Court through administrative channels or in the context of constitutionality review, with a view to a necessary legislative amendment of the procedure for dealing with exceptions of unconstitutionality as a whole.
