Special confiscation. Substances likely to cause psychoactive effects held for own consumption

Abstract

According to Art. 112 para. (1) letter b of the Code of criminal procedure, the assets which were used in any manner, or intended to be used for committing an action provided for by the criminal law shall be subjected to confiscation if they belong to the perpetrator or if, in 
the event that they belong to another person, the latter knew the purpose of their use. It is mandatory to confiscate the respective substances, and a solution of their restitution to the investigated persons or to persons on whom they were found was contrary to the  purpose of Law no. 194/2011.
