Abstract

The reconstitution of the seniority for the period worked by the claimant in the CAP given that the archive of the former CAP could not be identified. The first instance court admitted the action based on the evidence with witnesses. The appellate court concluded that the statements of the witnesses do not relate to any other evidence in the file and that the claimant did not appear in any document at all.
