Service pension. Recognition of the right under court orders. Update of pension

Abstract

The claimant’s right to the service pension is not established by a court order, but by the decision issued by Argeş County Pension Fund, and the court orders are issued for maintaining in payment the retirement decision with a service pension, so that the defendant the Romanian Court of Accounts wrongly refused to communicate the income certificate. Those two court orders relied on by the defendant in the reasoning of its 
refusal refer, however, to decisions issued by C.J.P. Argeş, under which they attempted (unsuccessfully) to change the service pension of the claimant in a social insurance 
pension, as well as in relation to the amount of the pension as a result of these statements, however, the courts irrevocably established that the claimant had the right to a service pension in the initially established amount.
