Abstract

The legislator decided to be more restrictive in granting the service pension and considered that this right to a pension should be granted only for the actual activity as a judge/prosecutor and for part of the legal specialist activities expressly provided for, and not for all the periods during which the applicant held one of the positions provided for in Article 86 of Law no. 303/2004 (assimilated to seniority in the judiciary). Persons who, on reaching the age of 60, have another occupation at the time of retirement may be entitled to a retirement pension if they satisfy the conditions of seniority laid down in para. 1 and para. 3 of Law no. 303/2004.
