Appeal for annulment. Clerical error. Interruption of the time limit for bringing an action due to the declared state of emergency

Abstract

The President of Romania instituted a state of emergency by Decree no. 195 and by Art. 42 para. 7 of this normative act provided that "the time limits for the exercise of remedies in the cases referred to in para. (6), pending on the date of the establishment of this state of emergency, shall be interrupted, and new time limits of the same duration shall run from the date of termination of the state of emergency". The interruption of the period for exercising the right of appeal was initially for 30 days, and later for the same period by Decree no. 240 of 14 April 2020 - the state of emergency on the territory of Romania was extended.
