Abstract

The present paper aims at an in-depth analysis that will lead to a better understanding and clarification of the problems currently raised in the case law on the exercise of appeals in civil matters, especially from the perspective of how to approach and understand the grounds for cassation, an approach that we find useful especially since most often the exceptions invoked even ex officio in practice concern the inadmissibility of appeals but also the invalidity of the appeal under the terms of Article 489 paragraph 2 Code of Civil Procedure, for not falling within the grounds for quashing.
