Conflict of jurisdiction. Establishing the responsible court to resolve a request for revision

Abstract

In the absence of a contrary provision, the responsible court to resolve the request for revision is determined by the regulation in force at the date when the judgment appealed by this way was established, and not by the one which was in force at the time when the request for revision was filed. To consider otherwise would mean to change the legal nature of the appeal for retraction of the request for revision, meant to ensure the exercise of self-control by the court itself which ruled on the background of the trial, which would be inadmissible.
