Abstract

A decision issued by the National Audio-visual Council containing only a summons to enter into legality of an advertisement, without any other specific conditions and terms, cannot become an enforceable title by failure to challenge. Therefore, the provisions of Article 93 para. 3 of the Audio-visual Law no. 504/2002, entailing the direct jurisdiction of the administrative section of the court of appeal, without being necessary to file a preliminary complaint, shall only be applicable on the documents issued by the Council according to which a sanction has been ordered, and not a summons.
