Abstract

The provisions of art. 65 para. (5) of Law no. 263/2010 shall not represent a special rule od reducing the standard retirement age necessary for the registration for the pension for age limit, but a special rule regarding the partial early retirement pension. Thus, the legislator understood to grant a facility to those persons who have lived for at least 30 years in the areas affected by the residual pollution because of the extraction and processing of non-ferrous minerals containing copper, lead, sulphur, sulf, cadmium, arsenic, zinc, manganese, fluorine, chlorine, of metallic powders and/or metallurgical coke, as well as of emissions of ammonia and its derived products, respectively Baia Mare, Copşa Mică, Zlatna, Târgu Mureş, Slatina, Turnu Măgurele and Râmnicu Vâlcea, within a radius of 8 km around these localities, in the sense that they can register to partial early retirement pension based on the reduction of the standard retirement age by 2 years without penalties, according to the provisions of Article 65 para. (4).
