Offense of deception – the situation in which the offense aims at legal relationships with illegality appearance

Abstract

The special legal object of the offense of deception is represented by the protection of those social relationships of patrimonial nature whose formation, conduct and development involves the existence of a minimum good faith and confidence which should exist in the legal relationships. Accordingly, the offence of deceiving committed for the purpose of obtaining for himself or for another person an unjust patrimonial benefit when aiming at a legal relationship with illegality appearance shall not be provided for in the criminal law.
