Brief considerations upon the abuse of procedural law in criminal matters

Abstract
The abuse of procedural law is a current problem against which both the civil society and the authorities must react. No one shall be permitted to exercise his/her procedural rights in bad faith and for any other purpose than that for which said rights were recognized by the law, and therefore harm the rights of another person or the general law of the society that all relations, including the judicial ones, be carried out in good faith. We intend to analyze below the regulation of the abuse of procedural law in criminal matters and to take a thorough look at the "effectiveness" of the means available to the judiciary authorities to stop and sanction the exercise of criminal procedural rights in bad faith.
