Applicability of the General Regulation concerning data protection in the courts of law

Abstract

The courts of law are personal data operators, and the processing activity and the way in which these data circulate are limited to Regulation (EU) no. 679/2016, adopted by the European Parliament and the Council of the European Union. Personal data are processed by the courts either during their judicial function, which is governed by express derogatory rules contained in the Regulation (EU) no. 679/2016, or outside said function, in which case the courts of law act as “common law” operators and the activity is governed by the general norms which describe the manner in which personal data circulate and are processed.
