Abstract

According to Art. 36 and 37 of the ASF Norm no. 23/2014, the person injured as a result of the accident caused by an insured vehicle has the right to submit the claim to the insurer of the civil liability insurance of the car owner, and the latter has the obligation to solve the claim within the time limits defined by law and, subsequently, to pay the compensation within a mandatory legal timeframe.
The denial of the claim for indemnification on account of the need for further investigation and absence of proof of concrete investigations is similar to an arbitrary and 
unjustified denial triggering the insurer’s liability and ordering it to pay the delay penalties from the expiration of the 10 days after the insurer receives all the documents requested to the harmed person.
