Verification of the receivable of AAAS in the insolvency procedure. The justified refusal of the judicial receiver to enter the claim in the table of the debtor's obligations

Abstract

The appellant did not justify the claim invoked by submitting a writ of enforcement or a court decision, therefore the judicial receiver correctly proceeded to verify the claim. Thus, the appellant obtained a writ of enforcement on the obligation to perform upon debtor,  respectively the civil decision no. 343 / served on 15 December 2005 of Constanta Court of 
Appeal, but this writ does not justify the alleged claim invoked because it does not establish any payment obligation for debtor, but only an obligation to perform.
