Abstract

The establishment of the owners 'association (mandatory for former tenants' associations), on the one hand, and the appointment of its chairman, on the other, are linked, so that, in order to prove the capacity as a representative of the association, a natural person must prove:
– the legal establishment of the owners' association; and
– that the person was elected chairman at the general meeting of the associated members.
If the alleged representative does not prove either of these two operations, it means that person does not have the capacity as representative of the association.
