Abstract

The provisions of Article 1385 para. (2) Civil Code are not applicable in this case, as there is no clear evidence of future damage, given that the health condition of the civil party is to be checked at different intervals and the achievement of a certain biological age remains for any individual, even in a perfect health condition, a desideratum, and not a certainty, that can be guaranteed in a concrete way.
