Abstract

The provisions of Decision no. 586 / 13 September 2016 rendered by the Constitutional Court of Romania, according to which “the provisions of Article 25 para. (5) of the Code of Criminal Procedure, with reference to the provisions of Article 16 para. (1) letter f) of the Code of Criminal Procedure, are unconstitutional in terms of leaving the civil action unresolved by the criminal court, in case of cessation of the criminal trial, further to the 
limitation term of criminal liability”.
