Abstract

Lawfulness and merits of those stated and ordered in a court order cannot be censored by an application based on the provisions relating to the non contentious procedure.

By an application filed by way of non-contentious procedure which is in relation to case already settled by a court, the amendment of the judgment delivered by the court in the respective case cannot be requested and obtained.
The operative part of the court order cannot be amended by such way (neither directly, nor indirectly).
Such a result may be reached by filing the appeal provided for by law.
