Declaration of the early maturity of the debt. Effects on the limitation periods which run until the intervention time

Abstract

In case of execution of the successive benefits, the limitation period starts to run from the date on which each benefit becomes payable, as a general rule. Declaration of a loan as early due shall not produce any effects in relation to the limitation periods which run until the time of its intervention. The date of declaration of the early maturity of the loan cannot be taken into account as the commencement time of the limitation period, when it is not 
early, but occurred after the completion of the implementation of the agreement, and implicitly, after reaching the limitation period. Early maturity cannot be intended to circumvent the limitation period of the right to claim enforcement.
