Abstract

The report establishing the obligation to pay the penalties, issued by a public authority has the legal nature of an administrative act, in which case according to Article 2 and 8 of Law no. 554/2004, the competence to solve the request for recalculation of penalties belongs, in the appeal stage, to the Administrative and Fiscal Litigation Division.
