Application of late payment penalties in administrative enforcement

Abstract

Enforcement of obligations intuitu persone established by enforceable titles, frequently encountered in administrative litigation, is regulated both in the Code of Civil Procedure and in Law No 554/2004, it being necessary to determine the relationship between these rules in the context in which the special law expressly refers, in addition, to the ordinary law.

The Supreme Court has recently clarified, by decision no.21/5.04.2021, certain aspects of the matter, a situation which requires the identification of a clear solution regarding the application of penalties to judgments rendered in administrative disputes, which are enforced.
