Abstract

By amending the reorganisation plan with a specific content, which does not mention the way in which the appellant's current claim will be covered, together with other current claims arising during the course of the plan, the proposed amendment does not ensure the requirement of predictability, i.e. it does not include the prospects of recovery in relation to the possibilities and specifics of the debtor's business and the financial means available under Article 95 para. 1 of Law 85/2006.
