Toll for the use of forest roads. Conditions

Abstract

Article 87 of Law No 46/2008 does not establish an obligation to pay the toll, since the law only requires an order to be drawn up by the head of the central public authority responsible for forestry on how to use and transport on forestry roads, without regulating such a charge, the legal regime of which is to be further developed in a normative administrative act with legal force inferior to the law. The obligation to publish the order is required by law in order for the regulatory act to enter into force, failing which it will not be possible to produce the specific effects intended by the issuer.
