Abstract

The Authority had to find that although the civil servant has the possibility to request the extension of the civil service relationship even after reaching the minimum retirement age, this itself is different, so that indirectly, as a consequence of the conjunction of the relevant rules, women are discriminated against in relation to men, who can exercise this right of option by making a request to remain in service only 2 months before reaching the age of 65.
