Abstract

Art. 14 para. (8) of Law 85/2006 provides for a special situation of the time limit which cannot be waived in favour of the application of the general rule laid down in Art. 7 para. (9) of Law No 85/2006, which relates to the time of publication of the act in the BPI.

It does not appear from the case-file that the pandemic situation actually prevented the appellant from lodging her application within the time-limit, given that she was not required to appear at the court for that purpose and that she had alternative means of communication open to her, including in the present case.
