Placing the child with third party interveners who have enjoyed personal contact with the child

Abstract
In cases concerning the protection and promotion of the rights of the child, the court has a wide margin of appreciation and must take into account, in particular, the principle of respect for the best interests of the child. Where third parties who have previously obtained a court order to maintain personal relations with the minor intervene in a case concerning the replacement of the emergency placement measure by a placement measure, the court may, on the basis of the evidence, consider that it is in the child's best interests for the placement measure to be imposed on them to the detriment of the foster carer.
