Abstract

The Administrative Code has express provisions on the mandate of local councillors to represent the interests of the administrative-territorial unit, which do not contain an exhaustive regulation of the institution of representing the interests of the local public administration authority, i.e. the local council. A contrario, in school boards, the representation of the local council can be made both by the local councillor and by any other representative, under the terms of Law no. 287/2009 on the Civil Code, concerning the institution of representation. In essence, the representation of the local council, in the board of directors of pre-university educational establishments with legal personality, is not carried out exclusively by a local counselor, so that another natural person may also be empowered to represent it.
