Abstract

The role of the judge in the correct establishment of the procedural framework is manifested, mainly, by making the necessary efforts, in the sense of requesting explanations and clarifications from the plaintiff, including on the correct name of the defendant, but the modification of the procedural framework at the initiative of the court can be made only in the cases provided for in Article 78 of the Civil Procedure Code.
