Abstract
Through the present study, we proposed a brief presentation and analysis of some relatively recent elements of judicial practice belonging to enforcement courts invested with requests for the connection of enforced executions on the role of different bailiffs as well as other procedural incidents in the matter of enforced execution.
The legislative construction of various procedural incidents reveals the existence of points of contact between the principle of the active role of the judge and the principle of availability. The almost chemical reaction that occurs at the confluence of the two principles is a generating factor of a non-unitary practice.
