Abstract

In the recitals to Decision No 16/2020 – Panel for solving a matter of law (para. 139), the High Court of Cassation and Justice emphasized that in the light of Article 666 para. (5) of the Civil Procedure Code, the tax invoice can be used as an enforceable title only within the limits of determining the cost of services rendered for the month preceding the month in which it was issued.

However, from the explanations provided by the respondent itself, it is clear that invoice No SVLI – dated 28 September 2018 contains a previous balance, namely from December 2017, and in this situation cannot constitute a valid enforcement order.
