Arbitration award. Ruling on certain issues which have not been requested or it has been given more than it had been requested
DREPTUL AFACERILOR
Abstract
The acknowledgment of the arbitration tribunal, in the considerations of the arbitration award that it rendered, of certain issues relating to some documents (such as the false nature of some of them), cannot be interpreted in the sense of ruling on certain issues which have not been requested (extra petita), as these issues do not represent a concrete claim of any party, but only arguments raised by defendants in the statements of defence filed in this case, for the purpose of rejecting the request for arbitration.
