Abstract

Under the conditions regulated by the Government Emergency Ordinance no. 44/2008, private entrepreneurs carrying out their economic activity of operating an enterprise in the form of authorized natural person, individual enterprise or family enterprise, can constitute property divisions with special destination, designed for a specific activity, separated from the general pledge of creditors. Since all these legal forms of organization of private entrepreneurs, trade professionals, are entities without legal personality and own assets, the property divisions allocated to the economic activity carried out belong to the owner holding the property used to take the division with special destination.
