Abstract

The pay rise and the allowance for holding the PhD scientific title were provided by the law to reward the personnel with higher education, paid from public funds, if such training is useful for the position they hold. In determining this aspect, it is not strictly the field in which the PhD training was performed that is essential, but what the training consisted in, as the PhD papers usually approach several fields that interact. Considering the many categories of personnel paid from public funds, the courts must perform very diverse analyses, being decisively influenced by the concrete arguments of the parties as regards the usefulness of the PhD training in the work they carry out effectively within the public institution. This article identifies and analyses situations that occur in the judicial practice regarding the award/non-award of pay rise/allowance for the PhD scientific title in relation to the usefulness of the employee’s PhD training for the position they hold.
