Abstract

In order to restrain the incidence of this reason for revision, it is necessary that in the case, in which the judgment for which the review is requested was pronounced, the European Court to have found an infringement of fundamental rights and freedoms, this violation must have its cause in the court decision which is subject to review, and the consequences of the violation continue to occur. This reason for review aims to remove the damaging effects of the court decision that resulted in a violation of fundamental human rights, observed by a decision of the European Court of Human Rights.
