Abstract

The fact that the complainant's request addressed to the public authority has not been settled in a favourable manner does not equate to an unjustified refusal within the meaning of the provisions of the administrative contentious law. Decision no. 3/30.01.2017 of the HCCJ, is applied in civil litigations in which the refusal of the administrative-territorial unit to give away the land is verified.
