Abstract

The control document issued for finding and evaluating the damages that entails the patrimonial liability in accordance with the provisions of art. 6 paragraph 1 of O. U. G. no. 85/2006 is not an administrative act, as defined in the content of art. 2 let. c) of Law no. 554/2004. The act derives from the employment relationship and aims to determine the patrimonial liability of the responsible person, so that the jurisdiction belongs to the civil section, labour disputes. The control act does not create, modify or extinguish legal relationships of the nature of those arising from administrative acts.
