Abstract

The term of 60 days in which the fiscal creditor can fill in the request for the registration of the additional debt is a legal term, within which this request can be formulated. It protects a special right granted by the legislator to the fiscal creditor for the verification of the debtor and the elaboration of the supplementary declaration, being a term of decay, in the same time. In these circumstances, the creditor who filled in the supplementary debt declaration within the legal term cannot be sanctioned, regardless of whether the syndic judge established the deadline for drawing up the definitive table before the expiry of the 60-days term.
