Abstract

In order to lead to the absolute nullity of the contract, the illicit cause and the immoral cause must be common, that is, both parties must pursue an illicit or immoral purpose, or at least they must know it, the intention of fraudulating from a single party not being enough. The absolute nullity of the sale contract cannot be ascertained in the event that only the seller pursued an illicit and immoral cause, and it is imperative that any illicit and immoral cause be common from both parties.
