Abstract

If the convicted person does not agree to execute the punishment applied by the foreign judicial authorities in a Romanian prison, for checking the fulfilment of the condition provided for under Article 155 para. 1 letter d) of Law no. 302/2004, by reference to the provisions of Article 2 letter p) of the same regulation, it is necessary to determine not the circumstance in which the convicted person has close ties to the foreign state, but the circumstance in which he or she keeps such ties to the origin country.
