Abstract

In virtue of the provisions of Article 267 of the TFEU, the Court of Justice of the European Union was seized in relation to the interpretation of the provisions of Article 4 para. 3 of the TEU and Article 101 of the TFEU, in the event that these impose on the judicial authorities of the Member States the obligation to interpret the national rules governing the limitation period of the right of the Competition Council to apply civil sanctions in compliance with the regulation contained in Article 25 para. 3 of the Regulation (EC) no. 1/2003 and are opposed to the interpretation of a rule of national law in the sense that the act of interruption of the limitation period means only the formal act of initiation of the procedure of investigation of an anti-competitive practice, and the subsequent actions taken for the purpose of its investigation shall not fall within the same scope of the acts of interruption of the limitation period
